SYMBOT LTD

1. Acceptance of Terms

By downloading, installing, accessing, or using MeloMove, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are expressly prohibited from using MeloMove and must discontinue use immediately.

2. License Grant and Restrictions

SYMBOT LTD grants you a limited, non-exclusive, non-transferable, revocable license to use MeloMove for personal, non-commercial purposes only. This is a license, not a sale or transfer of title. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works from MeloMove.

3. Subscription Services

MeloMove offers a Free tier and Pro subscription (£3.99/month). Free tier: 1 AI recommendation per activity type per 24 hours, basic tracking, limited features. Pro tier: unlimited AI recommendations, activity analytics, mood analytics, nutrition logging. Subscriptions auto-renew monthly through Apple's In-App Purchase system. Cancel anytime via iOS Settings. No refunds for partial billing periods.

4. NOT MEDICAL ADVICE - Health and Fitness Disclaimer

MeloMove provides general fitness information and AI-generated workout suggestions for educational and informational purposes ONLY. MeloMove is NOT a medical device, does NOT provide medical advice, diagnosis, or treatment, and is NOT a substitute for professional medical advice from a qualified physician. SYMBOT LTD, its developers, and any AI providers are NOT healthcare professionals, physicians, or medical practitioners. NEVER disregard professional medical advice from your physician or delay seeking it because of information obtained through MeloMove. Always consult your physician before starting any exercise program or making health-related decisions.

5. Assumption of Risk - Physical Activity

You acknowledge and agree that physical exercise and fitness activities involve INHERENT RISKS including, but not limited to: muscle strains, sprains, fractures, joint injuries, cardiovascular events, heart attack, stroke, heat exhaustion, dehydration, equipment-related injuries, and DEATH. By using MeloMove, you VOLUNTARILY assume all risks associated with physical activity and WAIVE any claims against SYMBOT LTD for injuries or damages resulting from exercise.

6. Physician Consultation Required

You MUST consult your physician or qualified healthcare provider before beginning any exercise program, making dietary changes, or relying on any health calculations provided by MeloMove, especially if you have or suspect: heart conditions, high blood pressure, diabetes, pregnancy, recent surgery, joint problems, chronic illness, history of injuries, are over 45 years old, take medications, or have any medical condition. All metabolic calculations (BMR, TDEE, calorie recommendations) are estimates only and require verification by your physician or registered dietitian. Immediately stop exercising and seek medical attention if you experience chest pain, severe shortness of breath, dizziness, nausea, or unusual discomfort.

6a. Health Calculations and Nutrition Guidance Disclaimer

MeloMove provides estimated health calculations including Basal Metabolic Rate (BMR), Total Daily Energy Expenditure (TDEE), calorie targets, and macronutrient recommendations based on general formulas (such as the Mifflin-St Jeor equation). These are ESTIMATES ONLY and may not be accurate for your individual physiology, metabolism, or health conditions. Consult your physician or registered dietitian for personalized metabolic assessment and calorie recommendations. Nutrition recommendations are general guidance only. Consult your physician or registered dietitian before making dietary changes, especially if you have medical conditions, food allergies, diabetes, eating disorders, are pregnant/nursing, or take medications. Self-reported health information is NOT a medical evaluation. Recovery recommendations and timing windows are general guidance and should be verified with your physician if you experience unusual pain, prolonged soreness, or have medical conditions affecting recovery.

7. AI-Generated Content Disclaimer

AI-powered recommendations are generated by third-party LLM providers (OpenAI, Anthropic, Google) using YOUR API key, NOT by SYMBOT LTD. AI-generated content may contain errors, inaccuracies, inappropriate suggestions, or recommendations unsuitable for your specific health condition. SYMBOT LTD makes NO WARRANTIES regarding accuracy, safety, or appropriateness of AI-generated content. You are SOLELY responsible for evaluating and verifying all AI recommendations with your physician or qualified professionals before implementation.

8. User Responsibilities and Representations

You represent and warrant that: (a) you are at least 13 years old; (b) you have consulted healthcare professionals as appropriate; (c) you will provide accurate profile information; (d) you are physically capable of performing exercises; (e) you will use proper form and technique; (f) you will exercise in a safe environment; (g) you are responsible for your own API keys, costs, and compliance with LLM provider terms; (h) you will not use MeloMove for any unlawful purpose.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMBOT LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES INCLUDING BUT NOT LIMITED TO: injuries, death, disabilities, medical expenses, pain and suffering, property damage, lost profits, data loss, device damage, API costs, or any damages arising from use or inability to use MeloMove. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SYMBOT LTD IN THE PAST 12 MONTHS (which may be £0.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless SYMBOT LTD, its officers, directors, employees, contractors, and affiliates from and against ANY AND ALL claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from: (a) your use of MeloMove; (b) your violation of these Terms; (c) your violation of any rights of third parties; (d) injuries, accidents, or health issues resulting from exercise; (e) your LLM API usage, costs, or key management; (f) any negligent or wrongful conduct.

11. No Warranties - "AS IS" Provision

MELOMOVE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SYMBOT LTD DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SAFETY, ERROR-FREE OPERATION, UNINTERRUPTED ACCESS, OR THAT DEFECTS WILL BE CORRECTED. SYMBOT LTD MAKES NO WARRANTY THAT MELOMOVE WILL MEET YOUR REQUIREMENTS OR THAT RESULTS WILL BE SAFE OR EFFECTIVE.

12. Data Loss and Device Damage

You acknowledge that use of MeloMove may result in data loss, data corruption, device malfunction, battery drain, storage consumption, or device damage. SYMBOT LTD is NOT responsible for backing up your data. You are SOLELY responsible for maintaining backups and device security. SYMBOT LTD SHALL NOT BE LIABLE for any data loss, regardless of cause.

13. Third-Party LLM Services

MeloMove integrates with third-party LLM services (OpenAI, Anthropic, Google). You maintain a direct contractual relationship with your chosen provider. You are bound by your LLM provider's terms of service and privacy policy. SYMBOT LTD is NOT responsible for: LLM service availability, outages, costs, rate limits, policy changes, data handling, errors in AI output, or any LLM provider actions. All LLM-related issues are between you and your provider.

14. API Key Security and Costs

You are SOLELY responsible for: (a) securing your API keys; (b) all costs incurred through API usage; (c) monitoring your API usage and spending; (d) compliance with your LLM provider's usage policies; (e) any unauthorized use of your API keys. SYMBOT LTD SHALL NOT BE LIABLE for unauthorized API access, excessive charges, rate limit violations, or account suspension by your LLM provider.

15. Service Modifications and Termination

SYMBOT LTD reserves the right to modify, suspend, or discontinue MeloMove (or any features) at any time without prior notice and without liability. SYMBOT LTD may terminate your access for any reason including violation of these Terms. Upon termination, your license ends immediately and you must cease all use and delete MeloMove from your devices.

16. Subscription Terms and Cancellation

Pro subscriptions are billed monthly through Apple's In-App Purchase system. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage subscriptions via iOS Settings > [Your Name] > Subscriptions. No refunds for partial months. Prices subject to change with 30 days notice. Continued use after price change constitutes acceptance.

17. Refund Policy

All subscription purchases are processed through Apple's In-App Purchase system. Refund requests are subject to Apple's refund policies, not SYMBOT LTD's. Contact Apple Support for refund inquiries. SYMBOT LTD does not process refunds directly and has no obligation to provide refunds beyond what Apple's policies require.

18. User Conduct Prohibitions

You agree NOT to: (a) use MeloMove for any illegal purpose; (b) attempt to reverse engineer, decompile, or hack MeloMove; (c) share your API keys with others; (d) use automation tools or bots; (e) attempt to access SYMBOT LTD servers (none exist for user data); (f) violate any applicable laws; (g) infringe intellectual property rights; (h) transmit malicious code; (i) impersonate others.

19. Intellectual Property Rights

MeloMove, including all code, design, graphics, text, logos, and trademarks, is the exclusive property of SYMBOT LTD and protected by copyright, trademark, and other intellectual property laws. You acquire no ownership rights by using MeloMove. Unauthorized copying, modification, distribution, or commercial use is strictly prohibited and may result in legal action.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, United Kingdom, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of England and Wales. You consent to personal jurisdiction in these courts and waive any objection to venue.

21. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect. SYMBOT LTD's failure to enforce any right or provision does not constitute a waiver of that right or provision. No waiver shall be effective unless in writing and signed by SYMBOT LTD.

22. Entire Agreement and Modifications

These Terms constitute the entire agreement between you and SYMBOT LTD regarding MeloMove and supersede all prior agreements. SYMBOT LTD may modify these Terms at any time without notice. Modifications are effective immediately upon posting. Continued use after modifications constitutes acceptance. Review these Terms periodically for changes.

23. Survival

The following sections survive termination of these Terms: Limitation of Liability, Indemnification, No Warranties, Intellectual Property Rights, Governing Law, and any provisions which by their nature should survive.
